Even if it's not illegal (though I agree with you I think you can actually incur demerits using a phone whilst riding), it's inherently stupid as shown by a guy I saw doing it in Brisbane who almost fell off his bike.

I still think they shouldn't be used at all because most people don't pay attention to what's going on around them when glued to the phone.

Use of bike lanes by motorised two-wheelers (mainly food deliveries) has
become a problem in New York and it's starting to happen here.
I believe the road rules and fines apply to horse riders too - e.g drunk in charge of a vehicle.
